OVC’s lawsuit (with the Sierra Club) and Judge Cooper’s historic decision which compelled DWP to implement the Lower Owens River Project (LORP) in accordance with the terms of the LTWA and MOU:
- Judge Cooper’s June 2005 Statement of Decision regarding delay in re-watering Lower Owens River
- January 2005 petition for injunctive relief: delay in rewatering of Lower Owens River
- 2001 lawsuit against LADWP: failure to prepare LORP DEIR
Even after water was flowing in the lower Owens river, further litigation was required to get a LORP Ecosystem Management Plan which complied with the provisions of the 1997 Memorandum of Understanding, especially with respect to monitoring and adaptive management of the lower Owens River. Final court briefs in this case were filed in June 2009:
- September 2008 petition for injunctive relief: inadequate adaptive management plan for Lower Owens River
- Plaintiffs’ memorandum of points and authorities in opposition to defendants’ motion for summary adjudication
- Plantiffs’ response to defendants’separate statement of undisputed facts in support of defendants’ motion for summary adjudication
- Separate statement of undisputed material facts with reference to supporting evidence of support of plaintiffs’ motion for summary adjudication
- Plaintiffs’ notice of motion and motion for summary adjudication
- Plaintiffs’ memorandum of points and authorities in support of motion for summary adjudication
- Declaration of Donald B. Mooney in support of motion for summary adjudication
- Plaintiffs’ request for judicial notice in support of motion for summary adjudication
2010 CEQA Litigation regarding groundwater pumping for the Blackrock fish rearing facility:
- Petition for a Writ of Mandate against the Calfornia Department of Fish and Game challenging the adequacy of DFG’s Hatchery and Stocking Program EIR.
